    I’m from Ohio but I’ve been watching videos out Texas since the first time CJ Grisham got arrested. This is the very first time I’ve ever witnessed an officer actually know what 38.02 actually says! I was actually shocked when he gave the right answer.

    He gave 3 answers: 1 if you have been arrested you must identify
    2, if you are detained for an offense and you give false information …
    3. there is also the stop and identify portion of that, where if there is
    articulable reasonable suspicion (you have/will/are a crime) you can be asked for ID.
    (His understanding of #3 is questionable)
    And then you and patrick start stuffing words into his mouth. Shaddup!

    I am ambivalent because I don’t like people just making Youtube videos of cops and wasting time they could be serving your community… HOWEVER, there is no ambivalence when it comes public servant accountability. I without a doubt I appreciate and respect the job that most officers due… But, I’ve been on the opposite end (mostly as a kid) of the bad side of the law.. Arresting me, taking me to jail just because they could.. (For burning out on a beach as a teen – Galveston, Texas in the early 90’s) POS Cop was later arrested for multiple rapes of people in custody and thankfully committed suicide. Body Cams and people videoing, and cops finally knowing they can’t do shit about it without getting in serious trouble, is a HUGE PLUS.. It also covers them when bad actors do what they best! Thank God for the legit LEO’s that aren’t out there because they were picked on something Good video! (I’m not a cop.. I’m a con.. And I "approve of this message ;)" )

    Many cops know this, they just don’t tell you that when they’re demanding your ID, how often do hear in these thousands of audits does a cop say "Can I see your ID even though you don’t have to",…never

    The real problem with 38.02 is its Title Failure to Identify when (a) address refusal to ID upon lawful arrest and (b) which applies to false ID (1) arrested persons, (2) lawfully detained persons or (3) witnesses to crime. (1) thru (3) can refuse to provide ID because they are not under arrest. The law section should be retitled Failure To and False Identification.

    He might KNOW what 38.02 says, but does he go by it in the field? I know what the speed limit is, but I don’t always obey it.

    I’m clear on 38.02, but he goes on to say if there is RAS then you could be asked for your documentation. Someone please elaborate. I thought Texas wasn’t a stop and identify state…
