The California Supreme Court reached a decision in People v. Diaz that police may lawfully search mobile phones on arrested individuals, without first obtaining a search warrant. So with this ruling, should we just call privacy dead or are there still tricks to keep your personal information safe? Competitive Enterprise Institute’s Ryan Radia explains.

    Could it be argued that since we have moved towards a "paper free society" that data such as email and documents and photos, texts, and such can be considered personal papers and are therefore Constitutionally it is an illegal search and seizure of personal papers and effects.

    Put it this way you can watch the activity on a cellphone in real time. Police can do it without a subpoena or warrant. A warrant is obtained after the fact.

    Legally, you dont own your phone data. Your phone data belongs to your service provider. Including your phone number. The police had your phone number, when they identified you. They really dont need your phone.

    FYI : The US Supreme Court on June 25, 2014, Ruled unanimously that a warrant must now be obtained to lawfully search a cell phone. This overrules the California supreme court. This video is from 2011. Have a nice day.

    That’s correct, as long as it’s not immediate possession, not searchable, if you can reach it or voice activate it at arrest then it’s searchable, if possible turn it off android trow it into back seat, but I’ve seen’em lie an say it was laying on seat beside him.
